G&S Obtains Trial Verdict on Liability in Intersection Collision Case – February 2011

Plaintiff claimed our client ran a red light and struck her vehicle causing serious injuries. We obtained a defendants verdict after presenting the non-party testimony of three witnesses to support our client's claim he had the green light and was struck by plaintiff on his driver's side as he crossed through the intersection. Plaintiff claimed that regardless of who had the green light the fact that our client never saw her vehicle until just before impact, indicated that he was not keeping a proper lookout. Non-party witnesses were crossed on the fact that they did not actually see the color of light in insured's direction of travel. We argued that there was circumstantial evidence to support their testimony.
