Steven Mutz is an AV rated trial attorney with over 35 years of experience. His focus is the defense of medical malpractice cases, with particular expertise in dental malpractice litigation. He has taken dozens of dental malpractice cases to verdict and successfully resolved hundreds more. He is counsel for the largest dental clinic in the State of New York, personally handling and trying all of their malpractice cases. He has successfully defended dental cases involving all professional liability issues facing dentists, including claims of unnecessary treatments, broken files, fractured jaws, alveolar nerve paresthesias, over and underfilled canals, ill-fitting restorations, improper cantilevers, malocclusions, TMJ dysfunction, periodontal disease, failed extractions and apicoectomies, “battery,” consent issues, and even “unlicensed treatment.”
Steven also advises his dentist clients as to how to improve their record-keeping and Consent forms; and he has successfully defended his dentist clients before the Office of Professional Discipline (OPD) on disciplinary charges.
Steven has made multiple presentations and lectures to the New York Academy of General Dentistry, including how to avoid malpractice lawsuits and what to do when confronted with one, e.g. “Risk Management: An Update to Protect You.” Furthermore, he obtained a decision in a matter that dismissed dental malpractice claims of “unlicensed” treatment and improper prosthodontics and clarified the level of expert evidence necessary.
In addition to his interest in dental malpractice, Steven has recognized the growing use of physician assistants (PAs) in the 21st century practice of medicine and, thus, the need to defend these medical care providers, who are on the forefront, in a different way than physicians. As such, he has been on the cutting edge of PA law in obtaining multiple dismissals of PAs from high-exposure malpractice cases based on unique arguments as to their limited role, interpretations of 10 N.Y.C.R.R. §94.2, and expanding the edges of existing PA case law.
Not content to limit his practice to dental or PAs, Mr. Mutz has defended innumerable other type malpractice cases, including cases involving colonoscopies and bowel perforations, pain management and opioid prescriptions, nursing home decubiti, orthopedic and general surgery, laser and other plastic surgeries, and failure to diagnose various cancers.
Steven graduated from St. John’s University, summa cum laude, and obtained his law degree in 1982 from St. John’s University School of Law. Prior to joining Gordon & Silber he was counsel to the New York State Majority Coalition Leader Senator Dean G. Skelos, and a partner at a prominent medical malpractice defense firm and managing attorney in another. He was selected as a 2014 “Top Rated Lawyer” in the area of Litigation by Martindale-Hubbell. He has published several articles and has had his dental verdicts featured in The New York Law Journal.
Steven is a member of the American Bar Association and New York State Bar Association. He is a committee member of the Health Law and Insurance Law divisions of the New York County Lawyer’s Association. He is admitted to the federal courts of the Southern and Eastern Districts of New York.
Steven has just had published, on Kindle, a novel, that he coauthored with his wife, that is receiving rave reviews.
Steven lives in Connecticut with his wife Bernadette Shaw, and their daughter, as well as their rescued dog.
